Eviction Halted

Well, the day after I sent the last notice, I received all the money from the tenant and everything is back on track. She still owes us for one-half of the sewer bill for November, but we are waiting for the sewer office to send us the correct bill. What they should have sent us was a REFUND, since we initially put a $100 deposit down and closed the account midway through November. Instead, they sent us a BILL for one-half month's services. Needless to say, our frustration continues to grow with those people down there. It is run through the city, so if I have 5 mins to spare some time, I'm going to write a steaming letter to the Mayor about the need to revamp their office as it is being poorly run.

That's great news. Hopefully your tenant will remain in good standing now that she knows you really mean business. If she's late again, do you think you'll pick up with the eviction process right where you left off? I'm curious if she's regained any of your trust now that she's paid up.

John - Not really sure about the eviction thing. If it can be avoided, I will definitely do it. This tenant, though, just seems to really test us. As far as the trust thing ... I lost trust in her back in October when, after repeatedly asking her if she had opened a sewer account, she lied to me by saying 'yes' when she knew bloody well she hadn't. Again, this was on multiple occasions. I told her when we were going over the contract that I am usually lenient to some things, and if she has a problem paying rent and calls and we can work out an arrangement, I may be willing to waive the late charges. No calls at all, just an empty mailbox. So, yes, the trust thing is out the door.

For now, she still owes us for one-half month's sewer bill, which I told her she will need to pay when we can get her a copy of the bill. If she's late in January, I'll probably just send her another letter and/or call her, and just rack-up the late charges again. It all really depends on IF she pays everything.

I don't mean to be rude, but sometimes we cause our own problem. In this case, I think you are just too lenient. How about put some anger or aggression? Be rude, perhaps? Anyway, I guess this is your somewhat lesson learned thingy. However, let me tell you something new for everybody in the real estate business.
